Terms of Service
1. Acceptance of Terms
By installing, accessing, or using ShopMentions ("the Service"), you ("Merchant") agree to be bound by these Terms of Service. If you do not agree, do not install or use ShopMentions.
These terms supplement the Shopify Partner Program Agreement and the Shopify API Terms of Use. In the event of a conflict, Shopify's terms take precedence.
2. Description of Service
ShopMentions is a Shopify app that monitors how your brand and products appear in AI-generated responses across platforms such as Perplexity and ChatGPT. The Service provides automated weekly scans, visibility scoring, brand intelligence, and competitive benchmarking.
ShopMentions relies on third-party AI services — including Perplexity AI and OpenAI — to generate scan results. The availability, accuracy, and format of those results are determined by those third-party platforms.
3. Account & Access
- Access to ShopMentions is provided through the Shopify Admin as an embedded app.
- Each Shopify store corresponds to one ShopMentions account.
- You are responsible for maintaining your Shopify account and ensuring that only authorised members of your organisation access ShopMentions through it.
4. Billing & Subscriptions
All billing is processed through Shopify's billing API. ShopMentions does not collect or store payment information directly.
- Plans — ShopMentions offers Starter, Growth, and Pro plans, billed monthly through Shopify.
- Free trial — The Starter plan includes a 7-day free trial. You will not be charged until the trial period ends.
- Monthly credits — Each plan includes a monthly credit allowance that resets at the start of each billing cycle. Unused monthly credits do not roll over.
- Credit packs — Additional credits may be purchased as one-time top-ups through Shopify. Credit packs are non-refundable and never expire.
- Cancellation — You may cancel your subscription at any time. Access continues until the end of your current billing period, followed by a 3-day grace period.
- Plan changes — To change your plan, please contact support@shopmentions.com.
5. Acceptable Use
You agree not to:
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Scrape, republish, or redistribute scan results or data produced by the Service.
- Use the Service to spam, manipulate, or artificially influence AI platform rankings or recommendations.
- Share or transfer access to ShopMentions outside of your Shopify store organisation.
- Use the Service for any unlawful purpose or in violation of Shopify's Acceptable Use Policy.
We reserve the right to suspend or terminate accounts that violate these terms.
6. Intellectual Property
- Our property — ShopMentions, its user interface, branding, and underlying technology are owned by ShopMentions. Nothing in these terms grants you rights to our intellectual property beyond the right to use the Service.
- Your data — You retain full ownership of your brand, product, and store data.
- AI-generated content — Scan results contain responses generated by third-party AI platforms. ShopMentions does not claim ownership of this content.
7. Data Handling
Our collection, use, and protection of your data is governed by our Privacy Policy. By using ShopMentions, you agree to its terms.
8. Aggregated Data & Research
We may use anonymised, aggregated data derived from the Service — such as trends in AI platform recommendation patterns, category-level visibility statistics, and brand mention frequency — for research, data studies, reports, and product improvement. This data will never identify individual stores, merchants, or their specific products. No personally identifiable information or store-identifiable information will be included in any published research or reports.
9. Third-Party Services
ShopMentions depends on third-party services to operate, including Perplexity AI, OpenAI, Anthropic (Claude), Google (Gemini), Supabase, and Sentry. We are not responsible for downtime, changes, or service interruptions caused by these providers.
AI-generated results are produced by third-party platforms and may contain inaccuracies, omissions, or outdated information. ShopMentions does not guarantee the accuracy, completeness, or reliability of any AI-generated content.
10. Disclaimers & Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not guarantee uptime, accuracy, or completeness of AI-generated results.
- AI platforms may change their behaviour, algorithms, or availability at any time, which may affect the results provided by ShopMentions.
- Visibility scores, rankings, and competitive data are informational only and should not be relied upon as guarantees of performance or commercial outcomes.
To the maximum extent permitted by law, ShopMentions' total liability for any claims arising from or related to the Service shall not exceed the total fees paid by you to ShopMentions in the twelve (12) months preceding the claim.
11. Termination
- Either party may terminate the agreement at any time.
- You may terminate by uninstalling ShopMentions from your Shopify store.
- Upon uninstallation, all store data is deleted from our systems when Shopify sends the mandatory shop data erasure webhook, typically within 48 hours of uninstall.
- We may suspend or terminate your access if you violate these terms or the Acceptable Use provisions above.
12. Changes to Terms
We may update these Terms of Service from time to time. Material changes will be communicated via in-app notification. Continued use of ShopMentions after such notice constitutes acceptance of the updated terms. We encourage you to review these terms periodically.
13. Governing Law & Disputes
These terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
In the event of a dispute, the parties agree to attempt to resolve the matter through good-faith negotiation before pursuing any formal proceedings. Any unresolved disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
